The Probate Court handles all marriage filings in Franklin County. The office is in the county courthouse in Russellville. Staff are helpful with questions about the filing process. They can explain what documents you need and how to complete them.

The recording fee is $75 in Franklin County. This covers the cost to file and record your marriage license. The fee includes state and county portions. Part goes to the Domestic Violence Trust Fund by law.

Marriage License Laws in Alabama

Alabama eliminated marriage licenses in 2019. Now couples file a license instead. Alabama Code Section 30-1-9.1 established this system. The change took effect August 29, 2019.

No ceremony is needed. No officiant is required. No witnesses are necessary. The marriage is a contract. Both parties sign, get it notarized, and file with any county Probate Court. The marriage becomes legal on the date of the second signature.

Age rules apply. Both must be 18 to marry without consent. Ages 16 and 17 need parental consent through a notarized affidavit. Under 16 cannot marry. See Section 30-1-4 for age requirements.

Divorced recently? Wait 60 days before filing a new marriage license. This period starts from your final divorce decree date. File too soon and the court rejects your form.
